Law 21,719 on data protection: what companies must do before December 2026

Law 21,719 completely modernizes the personal data protection regime in Chile and takes effect in December 2026. It raises the standard to levels close to the European one and introduces an authority with sanctioning powers. Any company processing data of clients, employees or suppliers should start adapting now; arriving late means exposure to fines and reputational damage.

Simplified regime or public deed to incorporate?

The 'Company in a Day' regime works for many ventures. But when there are several shareholders, significant contributions, investors or a shareholders' agreement, a tailor-made structure by public deed is advisable to prevent future conflicts.

What is due diligence and when is it needed?

It is a legal and documentary review of a company before buying, investing or partnering. It identifies risks and hidden liabilities and lets you negotiate price and warranties with real information. It is key in any M&A transaction.

What does Law 21,719 require from companies?

From December 2026 it raises the data processing standard: lawful bases, duties to inform, security measures, management of data subjects' rights and, in many cases, a record of activities and impact assessments. Processes and contracts should be adapted before it enters into force.
